These General Terms and Conditions of Sale (hereinafter “GTCS”) govern all sales made via the website companya.fr.

They define the rights and obligations of the Companÿa association and its customers regarding the sale of products and services offered on the site.

Any order placed on the site implies unreserved acceptance of these GTCS.

2. Scope of Application

These GTCS apply to:

the sale of physical music media, particularly CDs;

requests for artistic services or performances made via the site.

They apply to any natural person acting as a consumer, as well as to professionals where specified.

The Companÿa association reserves the right to modify its GTCS at any time. The applicable GTCS are those accepted by the customer at the time of the order.

3. Products Offered

The products offered for sale are described and presented with the greatest possible accuracy.

They may include, in particular:

music CDs;

phonographic productions;

media related to artists supported by the association.

Photographs and illustrations on the site are non-contractual and may show slight differences from the actual product. The Companÿa association reserves the right to withdraw a product from sale, either temporarily or permanently.

4. Ordering

The customer selects the products they wish to purchase and confirms their order after verifying:

the selected products;

the quantities;

the delivery address;

the total amount.

Confirming the order constitutes acceptance of these General Terms and Conditions of Sale.

A confirmation email is sent to the customer after the order is confirmed.

The Companÿa association reserves the right to refuse an order in the event of:

product unavailability;

a manifest pricing error;

suspected fraud;

an unresolved prior dispute.

5. Prices

Prices are quoted in euros (€).

As the Companÿa association is not subject to VAT for the activity in question, the prices shown represent the actual amount payable by the customer.

Delivery costs are calculated based on:

the destination;

the weight;

the chosen shipping method.

The total order amount is displayed before final confirmation.

6. Payment

Orders are paid for via:

PayPal

Payment is due immediately upon placing the order.

The order is considered final once payment has been confirmed.

Transactions are secured by the payment systems provided.

The Companÿa association does not have access to the customer’s confidential banking details.

7. Delivery

Orders are shipped to the address provided by the customer when placing the order.

Delivery is primarily handled by:

La Poste

The Companÿa association reserves the right to select a different carrier depending on the destination or logistical constraints.

Estimated delivery times are:

5 to 10 business days

starting from order confirmation and receipt of payment.

These timeframes may vary depending on:

the destination country;

periods of high activity;

events beyond the association’s control.

8. Delivery charges

Delivery charges are calculated automatically based on:

the delivery location;

the order specifications.

Delivery is not free, except in the case of a special promotional offer indicated at the time of the order.

9. Right of withdrawal

In accordance with Articles L221-18 et seq. of the Consumer Code, the consumer customer has a period of 14 days from receipt of the product to exercise their right of withdrawal.

The customer must notify the Companÿa association of their decision in writing:

The product must be returned:

complete;

unused;

in its original packaging;

in perfect condition, suitable for resale.

Return costs are to be borne by the customer.

10. Exception to the right of withdrawal

In accordance with Article L221-28 of the Consumer Code, the right of withdrawal cannot be exercised for CDs or recorded media that have been unsealed after delivery.

Consequently, a CD with opened protective packaging cannot be returned, due to copyright and reproduction rights protections.

11. Defective products or delivery errors

In the event of:

a damaged product;

a non-conforming product;

a shipping error;

the customer must contact the Companÿa association as soon as possible at:

A solution may be proposed, such as:

product replacement;

refund;

exchange.

12. Statutory warranties

Products sold are covered by:

the statutory warranty of conformity provided for in Articles L217-3 et seq. of the Consumer Code;

the statutory warranty against hidden defects provided for in Articles 1641 et seq. of the Civil Code.

The customer retains their rights independently of any potential commercial warranty.

13. Requests for performances and artistic services

The form available on the website allows event organizers to submit a request for a performance.

The information requested may include, in particular:

desired date;

times;

performance duration;

audience capacity;

venue;

type of event;

budget;

desired group or artist;

technical requirements;

requester’s contact details.

Submitting a form does not constitute a firm booking or a contractual commitment.

Any performance will be subject to:

prior discussion;

a price quote;

a contract or written agreement specifying the terms of execution.

14. Liability regarding performances

The Companÿa association undertakes to deploy the necessary resources to ensure the agreed performances are carried out. However, it shall not be held liable in the event of circumstances beyond its control:

force majeure;

insufficient security conditions;

technical impossibility;

external events preventing the performance of the show.

15. Intellectual Property

Musical content, photographs, videos, texts, and artistic elements presented on the site remain protected under the Intellectual Property Code.

Any reproduction, distribution, or exploitation without prior authorization is prohibited.

The purchase of a CD does not confer any right to reproduce or commercially exploit the musical works contained therein.

16. Consumer Mediation

In accordance with Articles L612-1 et seq. of the Consumer Code, the consumer client may have recourse to a consumer mediator free of charge for the amicable resolution of a dispute.

These General Terms and Conditions of Sale are governed by French law.

In the event of a dispute, the parties shall first seek an amicable solution.

Failing an amicable agreement, the competent courts shall be those designated in accordance with standard legal rules.
